Terms and conditions
These terms apply to every photoboothsoftware.eu subscription. Version 1.0, valid from 1 January 2026.
1. Definitions
Supplier: MADA Tech, registered at Lauwers 9, 9405 BL Assen, Chamber of Commerce number 88935361, publisher of photoboothsoftware.eu. Customer: the company that takes out a subscription. Software: the web environment, photo booth applications, agents and related services. Guest: the visitor who starts a photo session at one of the customer's photo booths.
2. Applicability
These terms apply to all offers, subscriptions and services provided by the supplier. The customer's purchasing terms are expressly rejected unless otherwise agreed in writing.
3. Subscription and trial period
A subscription is established when an environment is created or a quotation is accepted. The trial period lasts seven days and is without obligation. If the subscription is not cancelled before the end of the trial period, the selected package will start automatically.
4. Right of use
The customer receives a non-exclusive, non-transferable right to use the software for the number of photo booths included in the package. The software may not be copied, reverse engineered or resold under the customer's own name, except through the white-label and subletting modules included in the selected package.
5. Prices, invoicing and payment
All amounts are per month and exclude VAT. Payments are processed via Stripe by direct debit, iDEAL or card. Invoices are available in the management environment. If a payment fails, a reminder will be sent. If payment remains outstanding, the supplier may block the environment and connected photo booths until full payment has been received.
A discounted offer, such as fifty percent off for the first three months, only applies when a subscription is taken out immediately with payment details and cannot be combined with other promotions.
6. Term, changes and cancellation
Subscriptions run monthly. After the first month, you can cancel at the end of the current billing period via the management environment or by email. Upgrades take effect immediately and the difference is charged pro rata. Downgrades take effect from the next billing period. Amounts already paid are non-refundable.
7. Availability and maintenance
The supplier aims to provide 99.5 percent availability of the online environment per calendar month, excluding announced maintenance. The photo booth software is specifically designed to keep working without an internet connection and synchronises later. Maintenance is performed outside evening and weekend hours whenever possible.
8. Support
Support is provided in Dutch on working days between 9.00 and 17.00 by email and telephone. Issues occurring during an event are given priority. Support does not include hardware repairs or on-site work unless agreed separately.
9. Hardware
Each package is a software subscription. The photo booth, camera, printer, button and network equipment are not included. Hardware can be supplied separately on a quotation basis and is subject to the manufacturer's warranty terms.
10. Customer obligations
The customer is responsible for providing a suitable booth, power supply, network connection and proper setup, keeping login details confidential and informing guests about the use of their photos. The customer may not use the software for unlawful, offensive or criminal purposes.
11. Data and privacy
The customer is the data controller for photos and guest data. The supplier processes this data solely on the customer's instructions. The relevant arrangements are set out in the data processing agreement, which forms part of these terms and conditions. Data is processed within the European Union.
12. Intellectual property
All rights to the software, designs, documentation and brand names remain with the supplier. Photos, logos, templates and customer data provided or generated by the customer remain the property of the customer.
13. Liability
The supplier's liability is limited to the amount paid by the customer for the subscription during the three months preceding the event that caused the loss. Liability for consequential loss, lost revenue, missed savings and loss of image files is excluded. This limitation does not apply in cases of intent or deliberate recklessness.
14. Force majeure
Force majeure includes, in any event, outages affecting hosting providers, internet or power outages, cyberattacks and government measures. If a force majeure event lasts longer than thirty days, either party may terminate the agreement without liability for damages.
15. Termination and data export
After termination, the environment remains accessible for thirty days to allow photos and data to be exported. The data is then permanently deleted, except for data the supplier is legally required to retain, such as invoices.
16. Changes to the terms and conditions
The supplier may amend these terms and conditions and the prices by giving at least thirty days' notice. If a price increase exceeds the standard indexation, the customer may cancel the subscription as of the effective date.
17. Governing law
This agreement is governed by Dutch law. Disputes will be submitted to the competent court in the Northern Netherlands district, Assen location.
